Dangerous Instrumentality Doctrine Preempted in Florida for Aircraft

The "dangerous instrumentality" doctrine in the State of Florida makes owners of such dangerous instrumentalities (cars, trucks, boats, aircraft, etc.) strictly vicariously liable for any and all negligence committed by the operator. This important doctrine has been ruled by the Florida appeals court to be pre-empted by a federal law that supercedes that owner's liability.
