Central Florida Medical Negligence and Surgical Errors Attorney: Winter Haven, Lakeland

Unfortunately many patients suffer injuries because of surgical errors or medical mistakes; this is commonly referred to as medical malpractice or medical negligence. Poor pre-operative planning, anesthesia mistakes, infection, incorrect incisions, or operating on the wrong site are several examples of medical negligence. The culprit is often a negligent, careless, or inexperienced doctor or nurse.  After suffering from surgical errors, it is wise to seek out a medical negligence lawyer for legal representation. Residents of Central Florida, including Lakeland, Winter Haven, Bartow, Haines City, and Polk County, can contact Moody Law for a discussion of patient’s rights. Surgical Errors

Surgical errors are not limited to a certain type of procedure. Each attorney at Moody Law, based in Central Florida, has worked with patients injured during laparoscopic surgical procedures, robotic procedures, gallbladder surgeries, appendectomies, orthopedic surgeries, neurosurgical, and obstetric procedures. All surgeries carry some risk of surgical complications, anesthesia reactions, blood clots, infection cardiovascular complications, and healing complications.  However, patients who suffer complications because a doctor wrongfully failed to operate according to standards of professional skill and care are entitled to be compensated for their injuries.

In some cases of medical malpractice, a foreign object is left in the patient’s body during surgery. These foreign objects include instruments such as a sponge, clamp, pair of forceps, needle, or other paraphernalia commonly used in surgery, examination, or diagnostic procedures. Florida’s medical malpractice laws shift the burden of proof from the patient to the negligent doctor or nurse who left the foreign object in the patient's body. A prima facie case, or evidence of medical malpractice on the part of the doctor, nurse, or hospital is made by the mere fact that the object was left in the patient’s body.  In other words, the patient only has to prove that the doctor or nurse left the object in the patient’s body.

Anesthesia Errors

A majority of surgical errors involve administering anesthesia. The injury to the patient can be life-threatening - sometimes causing permanent brain damage, coma, organ damage, asphyxia, cardiovascular problems, or even death.
