Our client, a 32-year-old mother of three children, presented to her treating physician with signs and symptoms of a pulmonary embolism. Both visits were within a few days apart. On both occasions, the doctor sent her home without recognizing the urgency her condition. This lack of recognition or negligence by the doctor resulted in the sudden death of our client a short time thereafter. Medical Malpractice – Improper Titration of AED’s – Wrongful Death
Our client, a 21-year-old young man, was a known sufferer of epileptic seizures. This case involved a retired hard-working lady who had a significant mass on her lung. Radiographic films clearly showed the mass, but the radiologist misread them. This case was ultimately resolved for a high six-figure recovery for our client.
Medical Malpractice – Nursing Home Negligence
Our firm has successfully obtained a substantial six-figure recovery in a nursing home malpractice case involving the death of a nursing home resident due to abuse and negligence. Our client was the surviving daughter of her mother, a nursing home patient, who was left unattended, seat-belted in a wheelchair. Mr. Moody represented the surviving spouse and minor children of a deceased mine worker in his thirties. This industrial case involved a phosphate mine where an industrial worker was sucked into a scrubber tank and wrongfully killed. We prosecuted product design liability claims against numerous corporate defendants who designed and manufactured the scrubber tank system resulting in a substantial award to our client.
Product Liability - Wrongful Death – Woodchipper
A young mother was working on the jobsite where tree and bush trimming was occurring. While placing branches into the woodchipper, the client was accidentally pulled through the woodchipper machine and killed. This accident could have been prevented by a different design of the machine. A product liability suit was filed against the manufacturer and a substantial confidential settlement was reached.
Product Liability – Battery Explosion – Blindness
The client was a mechanic who was blinded as the result of an exploding battery. The client was a former U.S. Army Airborne Ranger who suffered a loss of sight impairment equating to loss of enjoyment of his work and life. Our client, a tire mechanic, was changing a tire when the tire exploded, causing him to lose a portion of his hand. The tire dealership was sued for the defective tire. A six-figure recovery resulted.

Our client, a stock clerk at a large retail store, was injured while handling a can of crystallized cleaner that exploded in her face. She inhaled vapors, resulting in serious damage to her lungs. The case was litigated and a substantial six-figure award was obtained just prior to trial.
Aviation – Single Engine Plane Crash
This case involved the death of a young woman who was killed while riding as a passenger in a private single engine aircraft. She was survived by a minor child. The aircraft pilot was not instrument rated, and therefore, not authorized by the F.A.A. to fly in adverse weather. At the time of the crash the weather was adverse with low ceilings. The pilot became disoriented resulting in uncontrolled flight into terrain. The pilot was also killed. The case resulted in a confidential settlement to the client.

Our client, a grandmother, was returning to her car from a fast food restaurant when she tripped on a piece of reinforcing bar protruding up from the pavement. The client tripped and fell striking her head, which resulted in her death. The fast food company was sued and a substantial six-figure recovery was obtained.

A 14-year-old suffered severe injuries, fractures and lacerations to his foot when a running riding lawn tractor lunged forward and his foot was cut by the blades. Hunting Accident – Joint Venture Liability – Wrongful Death
We represented the wife and children of a man who was shot and killed while hunting. The shooter was clearly negligent and he had his own policy of insurance. The hunting club that supervised the entire hunting operation had a separate policy of insurance. The hunting club had engaged in a joint venture with landowners, including the shooter, all of whom contributed their property for the purpose of running a hunting club. We argued successfully that Florida law imposed vicarious liability on the hunting club for any and all negligence committed by the shooter. Ranch Owner – Liability – Fire/Explosion Injury
Our client, a young teenage boy, was severely burned from a gas fire. The ranch owner had switched a can of fuel containing kerosene to gas without the client’s knowledge. Our client was then instructed to light a fire which resulted in an explosion and severe burns to our client. The client was flown to a burn unit in Virginia for treatment and rehabilitation. A significant six-figure confidential settlement was ultimately reached.
Bank Fraud – Fiduciary Duty Cases
