Truck Accident – Rear-End Crash by Commercial Truck
Our client was rear-ended by a commercial truck. As a result of the crash, her left lower extremity and other parts of her body were injured. Truck Accident – Wrongful Death
Our client was one of three 18-year-olds who were killed in a motor vehicle that was broad-sided by a semi-truck. The accident occurred at night on a highway with no street lights. The Defendant commercial truck driver alleged that the teenage driver ran a stop sign. Our expert found the commercial truck’s headlights may have been in the off position and that the commercial truck driver was driving too fast for weather conditions, in particular, early morning fog. MOTORCYCLE ACCIDENTS:
Motorcycle Accident – Multiple Fractures and Internal Injuries
This young man was passing multiple vehicles including a school bus, when a car ahead of him and to his right made a left-hand turn in front of him. Our client crashed into the car and was seriously injured. A six-figure recovery was obtained for our client.
Motorcycle Accident – Multiple Leg Fractures
Our client was riding a motorcycle when the driver of a car suddenly turned in front of him. Both our client and his passenger suffered leg fractures. Our client was thrown from the motorcycle during the accident resulting in multiple leg fractures requiring surgery. A six-figure recovery was obtained for our client. Our client’s motorcycle was a total loss and was sold to the insurance company as part of the recovery.
Motorcycle – Severed Leg
Our client was traveling the speed limit when another car invaded his right of way causing him to crash his motorcycle. As a result, our client’s leg was severed. His medical bills were substantial. Despite limited insurance, through the efforts of Mr. Moody our client received a recovery.

This case involved a young man who had a small growth on his body which a surgeon repeatedly treated by cutting. No radiation or chemotherapy was ordered or performed. The patient unfortunately succumbed to cancer during the course of the lawsuit. This case settled just before trial for approximately $1,200,000.00.
Medical Malpractice – Failure to Recognize Pulmonary Embolus – Wrongful Death
Our client, a 32-year-old mother of three children, presented to her treating physician with signs and symptoms of a pulmonary embolism. Both visits were within a few days apart. On both occasions, the doctor sent her home without recognizing the urgency her condition. This lack of recognition or negligence by the doctor resulted in the sudden death of our client a short time thereafter. A confidential settlement was made for the physician’s and medical clinic’s full policy limits of insurance on behalf of the client.
Medical Malpractice – Improper Titration of AED’s – Wrongful Death
Our client, a 21-year-old young man, was a known sufferer of epileptic seizures. His healthcare providers improperly transitioned him from one anti-epileptic drug to another without following the pharmaceutical manufacturer’s guidelines. The healthcare providers took him off the old medication and failed to give him an adequate dose of the new medication resulting in epileptic death by seizure. A significant confidential settlement was made for the physician’s and the clinic’s full policy limits of insurance on behalf of the parents.

This wrongful life case involved a child who was born seriously malformed. For this case, Mr. Moody flew his plane to meet with the world’s leading medical expert in this area of birth injury at the University of California, San Francisco, California. A nurse gave our client the wrong dosage of medication. Claim was made against a hospital nursing staff for permitting an elderly man to fall. The case was resolved for approximately $300,000.00.
Medical Malpractice – Negligent Shot or Injection
Our client was a middle aged female who underwent a minor operation in a local hospital. The client was given a shot of Demerol® for pain, which was incorrectly administered by the nurse. This resulted in a serious muscular and neurological injury. The case resolved in a substantial award of six-figures for the client.
Medical Malpractice – Breast Cancer
This case involved a retired hard-working lady who had a significant mass on her lung. Radiographic films clearly showed the mass, but the radiologist misread them. This case was ultimately resolved for a high six-figure recovery for our client.
Medical Malpractice – Nursing Home Negligence
Our firm has successfully obtained a substantial six-figure recovery in a nursing home malpractice case involving the death of a nursing home resident due to abuse and negligence. Our client was the surviving daughter of her mother, a nursing home patient, who was left unattended, seat-belted in a wheelchair. Thereafter, the patient slipped down underneath the seat-belt and the seat-belt choked the patient around her neck. The patient/client died. Product Liability – Wrongful Death – Scrubber Tank Malfunction
Mr. Moody represented the surviving spouse and minor children of a deceased mine worker in his thirties. This industrial case involved a phosphate mine where an industrial worker was sucked into a scrubber tank and wrongfully killed. We prosecuted product design liability claims against numerous corporate defendants who designed and manufactured the scrubber tank system resulting in a substantial award to our client.
Product Liability - Wrongful Death – Woodchipper
A young mother was working on the jobsite where tree and bush trimming was occurring. While placing branches into the woodchipper, the client was accidentally pulled through the woodchipper machine and killed. This accident could have been prevented by a different design of the machine. A product liability suit was filed against the manufacturer and a substantial confidential settlement was reached.
Product Liability – Battery Explosion – Blindness
The client was a mechanic who was blinded as the result of an exploding battery. The client was a former U.S. Army Airborne Ranger who suffered a loss of sight impairment equating to loss of enjoyment of his work and life. The manufacturer of the battery was sued and a confidential recovery resulted after extensive litigation.
Product Liability – Tire Explosion
Our client, a tire mechanic, was changing a tire when the tire exploded, causing him to lose a portion of his hand. The tire dealership was sued for the defective tire. A six-figure recovery resulted.
Product Liability – Can Explosion
Our client, a stock clerk at a large retail store, was injured while handling a can of crystallized cleaner that exploded in her face. She inhaled vapors, resulting in serious damage to her lungs. The case was litigated and a substantial six-figure award was obtained just prior to trial.

Aviation – Single Engine Plane Crash
This case involved the death of a young woman who was killed while riding as a passenger in a private single engine aircraft. She was survived by a minor child. The aircraft pilot was not instrument rated, and therefore, not authorized by the F.A.A. to fly in adverse weather. At the time of the crash the weather was adverse with low ceilings. The pilot became disoriented resulting in uncontrolled flight into terrain. The pilot was also killed. The case resulted in a confidential settlement to the client.

Slip and Fall – Slip and Fall Resulting in Death
Our client, a grandmother, was returning to her car from a fast food restaurant when she tripped on a piece of reinforcing bar protruding up from the pavement. The client tripped and fell striking her head, which resulted in her death. The fast food company was sued and a substantial six-figure recovery was obtained.

Our client was hired to trim a tree and while in the process of doing so, the client was distracted by the defendant. The distraction caused our client to fall from the tree and he was seriously injured. He suffered from eight broken vertebrae. Multiple homeowners’ policies of insurance were in dispute. The defendant disputed that she had distracted our client. The litigation resulted with the insurance company paying full policy insurance limits to our client. A confidential six- figure settlement was reached.
Homeowner Negligence – Riding Lawn Mower
A 14-year-old suffered severe injuries, fractures and lacerations to his foot when a running riding lawn tractor lunged forward and his foot was cut by the blades. This accident caused permanent and debilitating injuries to our client and a confidential six-figure recovery was obtained for our client.

Hunting Accident – Joint Venture Liability – Wrongful Death
We represented the wife and children of a man who was shot and killed while hunting. The shooter was clearly negligent and he had his own policy of insurance. The hunting club that supervised the entire hunting operation had a separate policy of insurance. The hunting club had engaged in a joint venture with landowners, including the shooter, all of whom contributed their property for the purpose of running a hunting club. We argued successfully that Florida law imposed vicarious liability on the hunting club for any and all negligence committed by the shooter. Full policy limits of insurance were tendered to settle the claim.
Ranch Owner – Liability – Fire/Explosion Injury
Our client, a young teenage boy, was severely burned from a gas fire. The ranch owner had switched a can of fuel containing kerosene to gas without the client’s knowledge. Our client was then instructed to light a fire which resulted in an explosion and severe burns to our client. The client was flown to a burn unit in Virginia for treatment and rehabilitation. A significant six-figure confidential settlement was ultimately reached.

Bank Fraud – Fiduciary Duty Cases
