A 3-year old boy was struck and killed by a car accident at Fort Mellon Park.  The boy was hit by a pickup truck after the boy went out into traffic.  The child was holding his father's hand at a hot dog stand at about 6:15 p.m. when he slipped away.  The boy ran between two cars and was hit by a westbound pickup truck.  The accident happened along RiverWalk, on Lake Monroe, near the Splash Pad, which is a water attraction for children.  The park was filled with people as was typical for a weekend.

Drivers of motor vehicles have a duty upon seeing a crowd of people or children to slow down and anticipate an accident.  Failure to do so when reasonable can be the basis for civil liability.  While a child may dart out into a roadway, the driver or owner of a motor vehicle can still be civilly responsible for the death of the child because that driver has a superior duty to keep a lookout for and anticipate erratic actions of children at play.  If you or a loved one has been injured as the result of a negligent driver, please contact a personal injury lawyer from Moody Law to discuss the particular facts and circumstances of your case.  Our personal injury lawyers offer a free consultation to review the facts of your case.  We handle select cases on a statewide basis, but most of our cases are in the greater Central Florida area, including Lakeland, Winter Haven, Bartow, Haines City, Auburndale, Polk City, Lake Wales, Davenport, and Polk County, Florida.
