The driver of a vehicle was killed in a car accident on Aloma Avenue in Orlando, Florida this morning.  The accident happened at approximately 11:30 a.m.  Three passengers suffered serious injuries.  Two passengers were transported to Winter Park Memorial Hospital.  News reports indicate that a Mustang coupe heading westbound caused the crash when the driver lost control and flipped into an SUV in the eastbound lane.  This crash is still under investigation.

While this car accident is still under investigation, it appears that the vehicle that crossed over the center line of the roadway is at fault for the accident.  Those persons injured due to the fault of another have a claim for bodily injuries against the person who caused them.  This means that the at-fault driver gets sued, but also, the UM (uninsured/underinsured motorist) carrier of the injured person may be sued as well if the damages exceed the at-fault driver's insurance limits or assets.  Florida law requires that you sue the at-fault driver for damages as opposed to just their insurance company.  In addition, if that case goes to trial, then the injured person is not permitted to disclose to the jury, or even imply, that the at-fault driver has insurance.  Anyone injured in a car accident should contact a Central Florida personal injury or car accident lawyer to discuss the particular facts and circumstances of the case.  A consultation with a Central Florida personal injury or car accident lawyer is free.
