Two Motorcyclists Seriously Injured in Car Accident

The Monday night accident with the pickup truck is reported to have occurred when a Yamaha sport motorcycle was going south on Seminole Boulevard when a Ford pickup truck, going north, made a U-turn.  The motorcycle was reported to have not had its lights on.  Police responded to the accident at 8:18 p.m.  Both motorcyclists were wearing helmets.

This accident as reported is difficult to understand.  For a number of years, motorcycles have been made so that you cannot drive them without the headlight on with the exception that the headlight may have been burned out or taken out.  As such, there is no "switch" on a motorcycle as there would be in a car to just drive without the headlight on.  Motorcycle headlights are designed to run all the time, both day and night.  It is possible that the headlight on the motorcycle may not have been working at the time of the accident.  However, if that is the case, then the motorcycle headlight would not have been working regardless of time of day and would have been dangerous even during the day.  For motorcyclists who are wearing helmets (even when there is a law in Florida that says that they do not have to wear them), I would be very surprised to find that they would have disabled the headlight or would have allowed the headlight to burn out.  Further, many modern motorcycles have more than one headlight or more than one filament (for high/low).  These facts would dramatically lower the chances that the motorcycle headlight was in fact not working.  But again, anything is possible and the facts will depend on what the actual investigation reveals.  I would suggest to the injured motorcyclists that they should seek legal counsel to discuss their rights and responsibilities as well as to go out and preserve the evidence (particularly the headlight or headlights).  If you or a loved one has been injured in a car accident in the greater Central Florida area, a personal injury or car accident lawyer with Moody Law can assist you with the case.  A consultation with a Central Florida personal injury or car accident lawyer is free.
