This accident involves two trucks and occurred at the intersection of SR 33 and Dean Still Road in Polk City, Florida.  One of the trucks was hauling a load of sand.  That truck turned on its side and the load of sand is blocking the roadway.  The area where this accident occurred is rural with relative high speed limits on the intersecting roads.  While this accident is still under investigation, this accident will likely be judged from the perspective of which driver was in a better position to avoid the collision rather than from who was necessarily right or wrong.  In other words, if a heavy truck pulls out onto SR 33 from Dean Still Road in front of another vehicle, then the vehicle on SR 33 should do everything possible to avoid a collision even if that means having to drive significantly slower than desired and braking hard.  I have noticed that many accidents occur at the intersections of high speed roadways where someone pulls out onto the highway and then is rear-ended because the vehicle on the highway feels entitled to maintain speed without having to accommodate the slower vehicle.  While I understand that this may be a very frustrating circumstance, however, the cardinal rule always has been whatever you do, do not allow your vehicle to come in contact with other people.  In other words, it does not matter who is right or who is wrong, stay away from other vehicles on the roadway.  Many of us call that plain old defensive driving.  If you or a loved one has been injured in a truck accident, please contact a Central Florida truck accident attorney for a free consultation about your rights and perhaps your responsibilities too following the accident.  Your truck accident claim may involved a complex web of motor vehicle insurance, workers compensation, and health insurance.
