Press Release:

On Wednesday Afternoon, May 18, 2022, a Polk County Jury awarded a Polk City man $50 Million Dollars for catastrophic injuries sustained in a crash caused by a drunk driver.  On April 23, 2020, Sean Ouellette was driving eastbound on Mt. Olive Road in Polk City, when Benjamin Kirkland attempted to pass the vehicle in front of him colliding head on with Mr. Ouellette. Benjamin Kirkland’s blood alcohol level was .309 or three times over the normal limit. Benjamin Kirkland remains incarcerated in prison.

As a result of the accident, Mr. Ouellette has undergone thirty-three (33) medical procedures including bilateral leg amputations. Relentlessly, Mr. Ouellette will continue his journey and is hopeful that future advances in prosthetics will allow him to live a life without limitations.

Attorney Drew Moody, of Moody Law, who represents Mr. Ouellette, stated that the Jury Verdict reflects our community’s response to the reckless actions of a drunk driver who selfishly took so much away from an innocent man and his family.  The Ouellette’s are hopeful that this verdict will send a message to those who will now think twice before drinking and getting behind the wheel. Mr. Moody said, “I hope Sean and his family can now start to put this tragedy behind them and look forward to life in the future.”
