House Bill 837 Changed the Way Florida Awards Compensation

Pure comparative negligence used to be the standard Florida used to award compensation in personal injury cases. This framework entitled plaintiffs to successfully obtain damages even if they were the primary cause of their accident. 

In March of 2023, Governor Ron DeSantis signed into law House Bill (HB) 837. This made sweeping changes to the way lawsuits such as those involving DUI accidents are governed. Florida now operates under the modified comparative negligence framework. 

The new change means that you generally cannot receive any compensation whatsoever if the judge and jury find you to be 51% or more at fault for your accident. House Bill 837 Also Recently Reduced Your Time Limit By Half

Statute of limitations laws set hard deadlines for when different types of lawsuits must be filed by. These deadlines vary from state to state. Florida used to have one of the most permissive statutes when it came to personal injury cases, providing victims with a full four years to file. 

The new legislation signed into law by Governor DeSantis cut this time limit in half. You now have only two years from the date of your drunk driving crash to file your lawsuit.
