I Was Offered a Big Settlement

Why Do I Need a Motorcycle Accident Lawyer?

Because it's most likely much less than you actually need. Insurance companies have virtually nothing to gain by paying you what you actually deserve. The less they pay you, the more they profit. On the other hand, Moody Law has everything to gain by helping you collect the biggest settlement or jury award possible. After all, if your case isn't a success, we don't get paid. Here is a quick look at three things our attorneys will do to ensure that you live your absolute best life after a motorcycle accident:

Calculate Your Losses

The consequences of a motorcycle accident are far-reaching. A victim's losses typically include much more than just medical bills and a totaled motorcycle. Injuries often keep victims unable to work for a long period. They may never be able to return to work in the same capacity; in many cases, they may be unable to return to work for the rest of their lives. Meanwhile, the physical and mental pain and suffering victims experience is a very real loss that Florida courts recognize. Moody Law will carefully calculate your total losses, and we will not settle for less than what you truly need to rebuild your life.

Deal With the Insurance Company

Even if you have purchased insurance for yourself as a motorcyclist, it's possible that your property damage, medical expenses, and other losses exceed what your policy will cover. Our job is to present the responsible party's insurance company with a highly detailed account of what you have lost due to their client's negligence and convince them that fighting us in court would be a waste of their time and money. Rest assured that if they won't agree to a settlement that will benefit you, we are ready to take your case to court.

Give You Time and Space to Heal

Convincing a giant corporate insurance company to honor the losses their client has caused is no small task. It takes legal expertise, financial resources, expert witnesses, and time. You and your family have suffered significant trauma, and you need time to concentrate on healing, both physically and emotionally. Put the burden of the necessary legal work on us. We collect absolutely no fees unless and until your case is successful. At that point, we will collect a percentage of the settlement or jury award — the rest belongs to you. Leave this fight to a firm that has repeatedly proven it can protect your best interests.

If You Lost a Loved One Moody Law Can File a Wrongful Death Claim

If a motorcycle cost you a loved one, Moody Law would like to extend our deepest condolences. When these tragedies occur, we take great pride in helping families pursue justice.

Survivors have two years to file a wrongful death claim. The sooner you involve Moody Law, the sooner we can begin building a case for maximum restitution. We will carefully calculate the extent of damages, including funeral expenses, loss of companionship, loss of financial support, your family's pain and suffering, and more.

Nothing can replace a lost loved one, but we can help you heal and move forward by collecting the restitution you and your family are owed. You have two years from the date of your loved one's passing to file a claim. Get in touch with us today so we can start building your case.

Lakeland Motorcycle Accident Facts

Every time a motorcyclist heads out on a ride, there is a risk. Many other drivers on the roads in Florida are simply not looking out for motorcycles, which can lead to accidents with severe consequences for riders. Statistics provided by the Florida Highway Safety and Motor Vehicles (FLHSMV) department over the last few years illustrate a large number of motorcycle accidents in Polk County:

1 out of 9 motorcycle accidents resulted in a fatality and 4 out of 5 crashes resulted in an injury
1 out of 11 motorcycle accidents resulted in a fatality and 4 out of 5 crashes resulted in an injury
In 2023, 345 motorcycle crashes, 281 injuries, and 21 fatalities

In spite of the stigmas, Moody Law knows that many motorcyclists are safety-oriented people making careful and defensive choices on our roadways. Has the negligence of another motorist, a parts manufacturer, a municipality, or any other party caused you or a loved one an injury on a motorcycle? Dangerous Intersections
in Lakeland

When the roads around Lakeland were originally developed, they were constructed to handle far less traffic. Since 1980, the population of Lakeland has more than doubled. With the growth of Greater Polk County and Central Florida, the number of vehicles on the road has significantly increased. Recently, the Florida Department of Transportation has adopted traffic calming devices to increase driver safety, including the construction of roundabouts at busy intersections across the state. While proven effective, these new intersections are controversial with the local population and have yet to be built at the most dangerous intersections in Lakeland, which include:

Memorial Boulevard and Massachusetts Avenue/North Florida Avenue intersectionMemorial Boulevard and Massachusetts Avenue/North Florida Avenue

The two most dangerous intersections on Memorial Boulevard in Lakeland are only three blocks apart. North Florida Avenue and, just to the west, Massachusetts Avenue are notorious for being two of the worst intersections in town. Although the city has installed red light cameras at Memorial Boulevard and Massachusetts Avenue, the intersection continues to pose a risk for both drivers and motorcyclists.

Griffin Road and U.S. Highway 98 North

Griffin Road and U.S. Highway 98 North

As the most dangerous intersection in Polk County, the city of Lakeland has added red light cameras to the intersection of Griffin Road and U.S. 98 North, as well as "tattle tale" lights, which can be seen in every direction in an attempt to reduce the risk for drivers. Even with additional police officers stationed to monitor drivers in the area, this intersection continues to see a significant number of accidents due to increasingly heavy traffic.

Common Causes of Motorcycle Accidents

With so many dangers present on the roads around Central Florida, it is important for motorcyclists to stay alert and aware of their surroundings at all times. Common causes of accidents in Central Florida include:

Driver on smart phone

Distracted Drivers

A driver not paying attention to the road can lead to serious consequences for motorcyclists, such as significant brain injuries or wrongful death. The Wireless Communications While Driving Law has made it illegal to text while driving in Florida, but the law is seldom enforced.

Failure to Yield

When drivers fail to yield, motorcycle riders are put in significant danger. Bikers may have only a fraction of a second to avoid a collision when another vehicle impedes their right of way. These types of accidents are especially dangerous when they occur near a busy intersection or on the highway, as they can result in serious injuries or wrongful death.

Driver with one hand on wheel and other holding beer bottle

Driving Under the Influence

Thousands of deaths each year are the result of drivers under the influence of drugs or alcohol. If you were run off the road, hit, or thrown off course because of someone else's erratic driving, our motorcycle accident lawyers can hold the driver accountable for their negligent actions. We can help secure financial compensation for medical bills, damages to your motorcycle, and lost wages related to your accident.

Yelling driver

Road Rage

Many riders of motorcycles and bicycles experience unjustified road rage from motorists. If you were involved in a crash that was due to a driver acting with blatant disregard for your safety, our motorcycle accident lawyers will work tirelessly to secure compensation for the injuries you have suffered. We can not only help you achieve justice, but by holding the reckless driver responsible for their actions, you may be able to protect riders in the future from a similar experience.

Dangerous Road Conditions

Even the most skilled rider may not be able to avoid dangerous road conditions. Hazardous road conditions, such as inclement weather and debris, affect motorcycle riders more often than passenger vehicles. While obstacles such as gravel, poorly maintained roads, railway tracks, expansion joints, and other hazards can cause car accidents, the lack of protection provided by a motorcycle means that these kinds of accidents can lead to serious injuries for bikers.

“Exceeded my expectations.”

“Just closed my case with Moody law. Have to say that I’m glad my brother sent me to them. They handled everything it was amazing. Debbie was the greatest! She helped me through the whole process. For my first time going through this they definitely exceeded my expectations.” — Daniel, 5-Star Review
