Fatal Accident in Lakeland By Moody Law | Personal Injury Attorneys on May 07, 2010

Lakeland, Florida.  A fatal car accident is currently being investigated.  The accident occurred at the intersection of State Road 33 and Socrum Loop Road in north Lakeland.  No details are available about the accident at this time.  However, police are investigating.

At Moody Law, our personal injury attorneys can help answer your questions regarding car accident and wrongful death cases.  Wrongful death cases in the State of Florida have some unique quirks that are significantly different than injury cases.  Wrongful death cases are subject to a short two year statute of limitations whereas injury cases are generally four years depending on the circumstances.  Second, wrongful death cases must generally be brought by a single personal representative on behalf of the estate and all of the survivors.  As such, each survivor may have a right to get his or her own attorney, it is not necessary and only the personal representative's attorney will be able to charge a fee unless there is a conflict of interest between the survivor and the personal representative.  These cases can get further complicated when the at-fault driver/owner dies.  Oftentimes, there will be no one to open a probate.  Without a probate, there is no legal entity to sue because the at-fault driver/owner is dead.  In these instances, the injured party must open the probate as a creditor and the court will appoint a personal representative, usually a professional one, to serve and defend the lawsuit on behalf of the estate.  These are all reasons why a person injured in a car accident or if you have a loved one who has suffered a wrongful death that you should speak to a personal injury attorney about your circumstances.  Moody Law serves greater Central Florida, including Lakeland, Winter Haven, Bartow, Haines City, Davenport, and Polk County, Florida.  We also handle a select number of personal injury, wrongful death, or medical malpractice cases on a statewide basis.  A consultation with one of our personal injury attorneys is free.
