Boy Hit by Car with Serious Injuries By Moody Law | Personal Injury Attorneys on May 17, 2010

Orange County, Florida.  A 3 year old boy was struck and seriously injured by a car.  The accident happened when a Jeep backed out of a driveway and then proceeded down the street, heading north.  The accident happened at approximately 2:45 p.m. on Poi Circle in east Orange County.  The boy, Warren Acoo III, was on a scooter.  The boy's father was behind him but was unable to stop him in tim.  The Jeep was driven by Geraldine Perry, 70.  Warrent was taken to Arnold Palmer Hospital for Children in Orlando.  No charges have been filed at this time.

This incident is certainly tragic for both the boy's family and the driver of the Jeep.  Notwithstanding, the driver of a motor vehicle has a heightened duty to watch for children in areas that are known to have children playing in the streets.  It is very likely that the driver of the Jeep had prior knowledge of children playing in the area around the residence that she left.  There is also a common understanding that driving through residential areas will involve a higher likelihood of encountering children.  As such, children are not held to the same standards as adults for blame for an accident.  For instance, it is well known that children can dart out into traffic.  However, drivers have a duty to slow down, look for, and anticipate that playing children might do such a thing, particularly in that residential area.  This very well could be the basis of civil liability in this incident.  If you or a loved one has been injured in a similar incident, personal injury lawyers with Moody Law are available to answer any questions you may have.  Our personal injury lawyers serve the greater Central Florida area, including Lakeland, Winter Haven, Bartow, Haines City, Davenport, or Polk County, Florida.  We also handle a select number of cases on a statewide basis.  A consultation with one of our personal injury lawyers is free.
