Seminole County, Florida.  A woman from Apopka, Florida was killed in a car accident on Interstate-4 near State Road 434.  The woman, Jessica Rena Hurst, 24, was a passenger in a 2001 Kia going east in the middle lane when the driver of the Kia, Justin Michael Jones, 24, of Altamonte Springs, Florida, suddenly veered right.  The accident occurred at approximately 9:16 p.m.  Jones' vehicle spun around and struck a Ford pickup truck that was stopped on the grass shoulder of the road.  Hurst was transported to South Seminole Hospital and died there.  Jones was sent to Orlando Regional Medical Center in critical condition.  There is no indication yet on whether Hurst or Jones were wearing seatbelts.  The driver of the pickup truck was Victor Sochocki, 41, of St. Cloud.  He was not injured.  Charges are pending.

The passenger of a vehicle has a right to sue the driver of the vehicle for negligence if he or she is injured by that driver's negligence.  In the event that a claimant dies, a personal representative on behalf of the estate has the right to sue the driver for negligence.  In such cases, the personal representative makes claims for both the estate and any survivors.  Who is a survivor is defined by Florida Statutes.  If you or a loved one has suffered the loss of someone due to an accident caused by the negligence of another, please contact a personal injury lawyer with Moody Law to discuss the facts and circumstances of the case.  There may be facts or legal matters that you may have overlooked or not considered.  A consultation with one of our personal injury lawyers is free.  Our personal injury attorneys handle significant injury cases from across the State of Florida.
