Car Accident in Polk Sheriff's Parking Lot By Moody Law | Personal Injury Attorneys on August 26, 2010

Bartow, Florida.  A car accident occurred in the parking lot of the Polk County Sheriff's Office.  Jeremiah Manning, 49, of Bartow, Florida, struck the rear-end of a 2000 Chevrolet truck, driven by Rolando Hernandez, 38.  Manning was driving a 2005 Ford Taurus at approximately 40 m.p.h. when the crash occurred.  Manning was listed in critical but stable condition.  This accident is still under investigation.  Police suspect that a pre-existing medical condition may have contributed to the accident.  Hernandez was taken to Bartow Regional Medical Center with minor injuries as well as his passenger, Maria Vasquez.  Both Hernandez and Vasquez are Bartow residents.

Most, if not all, car accidents are the result of some negligence.  However, the prevailing law in Florida and across the country typically do not find "negligence" in cases where the accident was caused by an involuntary medical condition, so long as that person was not instructed not to drive by a medical doctor.  This situation normally results in an unfair situation to the person who is injured and suffered a loss of property due to that accident because the insurance company from the person with the medical condition oftentimes does not pay because there is no negligence.  Notwithstanding that allegations of negligence may be made, it may be for a jury to decide whether it was negligence or the medical condition that was the actual cause of the medical condition.  Furthermore, we hope that the injured/damaged parties here had collision coverage and uninsured/underinsured (UM) insurance coverage.  Collision coverage is coverage that you buy for your own car that covers in regardless of whether the accident is your fault or another person's fault.  UM coverage is coverage that you buy for what other people do to you.  These are important coverages that you should not skimp on, particularly if you cannot afford to purchase another vehicle on your own and you do not have adequate health insurance to cover your medical bills.  If you of or a loved one has suffered an injury or damage as a result of a car accident in the greater Central Florida area, a Central Florida personal injury or car accident lawyer from Moody Law can help you sort through the rights and responsibilities of your case.  Our normal coverage areas include Lakeland, Winter Haven, Bartow, Haines City, Auburndale, Lake Wales, Ft. Meade, Frostproof, and all of Polk County, Florida, however we handle a select number of cases on a statewide basis.  Please contact a Central Florida or Lakeland, Winter Haven, or Bartow personal injury or car accident lawyer today for your free consultation or case evaluation.
