Lakeland Woman Hit by Car on Harden Boulevard By Moody Law | Personal Injury Attorneys on November 09, 2010

November 8, 2010.  A woman in Lakeland, Florida was struck by a car on Harden Boulevard.  This accident was reported at 7:22 p.m. on Monday night.  The accident happened at the intersection of Harden Boulevard and Ariana Street.  The name of the woman involved has not been released, but she was taken to Lakeland Regional Medical Center in critical condition.  The woman was struck in the southbound lane of Harden Boulevard.

There is not enough information to determine how this accident happened.  However, this is the type of car accident that police oftentimes have sympathy for the driver and do not charge the driver with a traffic offense.  Just because the driver does not receive a ticket does not mean that the driver was not negligent and that the driver could not have done something to avoid the accident.  Pedestrians make mistakes on the roadway just like drivers of cars.  While pedestrians are supposed to observe the crosswalk signals, they sometimes do not because they are in a hurry and are at a disadvantage on the roadway.  Those pedestrians frequently cross when they believe that they have enough time to cross even if they do not wait for the signal to change.  In such an instance, whether the driver was speeding or not makes a diffference as to liability in the case.  Assuming that the driver had the green light, the driver of a motor vehicle has a duty to watch for hazards in the roadway and to avoid them if at all possible even when the driver has the so-called right of way.  We must not forget that the roads are meant to be shared between all of us.  This means that we must anticipate mistakes by others and allow enough space and time to react those mistakes.  When we mistakes ourselves, we hope that other drivers will do the same for us.
