We represented the wife and children of a man who was shot and killed while hunting. The shooter was clearly negligent and he had his own policy of insurance. The hunting club that supervised the entire hunting operation had a separate policy of insurance. The hunting club had engaged in a joint venture with landowners, including the shooter, all of whom contributed their property for the purpose of running a hunting club. We argued successfully that Florida law imposed vicarious liability on the hunting club for any and all negligence committed by the shooter. Full policy limits of insurance were tendered to settle the claim.
