Young Mother Dies in Lakeland Accident By Moody Law | Personal Injury Attorneys on February 26, 2015

Kaylie Cadwell died as a result of a traffic accident on February 24, 2015.  She was southbound on Combee Road when her vehicle was struck by a 2008 Chevrolet Malibu driven by Jennifer Nestor.  Nestor's vehicle pushed Cadwell's vehicle into the northbound lane of Combee Road and she was consequently struck by a semi-truck coming from the opposite direction.  Kaylie is survived by her daughter, Brooklyn.  This collision occurred at approximately 6:30 a.m. on a day where there was significant fog.

Taking the facts as stated in The Ledger, it can be said that Ms. Nestor was improperly making her turn.  In thick fog, one may not be able to see across the roadway and may not be able to safely execute a left turn.  Under those circumstances, it may be necessary to turn right and change routes accordingly.  When using a frequently traveled route, drivers sometimes get complacent about the risks of the particular roadway and will sometimes do things that they would not normally do on an unfamiliar road.  One of the comments to The Ledger's reporting of this accident states that Ms. Nestor stopped in the southbound lane.  Again, I have to take the facts as reported, however, stopping in the southbound lane implies that there was not a collision between Ms. Nestor and Ms. Cadwell.  If there was no collision with Ms. Nestor, then she technically would not have a legal obligation to stop as she would not have been "involved" in the collision.  Without the ability to investigate this accident further, I have to assume that Ms. Nestor pulled out to make her left hand turn and then struck the driver's side of Ms. Cadwell's vehicle, causing it to veer to the left and into harm's way of the semi-truck.  That is the only logical conclusion that I can come to regarding the information presented.  This accident appears to be a tragedy through and through.  The survivors will likely be required to set up an estate and possibly a guardianship for the child.  If you or a loved one were involved in a Lakeland car accident, please contact a personal injury attorney for a free consultation.  There are both rights and responsibilities that follow an incident such as this.
