My Doctor Thinks I'm Having Complications Resulting from a Surgery I Underwent Years Ago. Can I Still Take Legal Action Against the Surgeon?

Possibly. There are two laws to consider: First is the statute of limitations regarding personal injury lawsuits in Florida, which gives victims two years from either the act of negligence or the discovery of the act of negligence; the second is the statute of response, which limits you to four years following the act of negligence, regardless of when it was discovered. In other words, if it took longer than four years to discover the effects of negligence, you cannot file a personal injury claim.

What If the Doctor Tried to Cover Up the Act of Negligence, and This Delayed Discovery of the Negligent Act?

In this case, you would have up to seven years to take legal action. Of course, being granted this extended window in which to file a lawsuit also requires proving that concealment or other tactics are to blame for the delay in discovering the true effects of the act in question. As with any set of circumstances relating to medical malpractice, the sooner you reach out to an attorney, the better.
